Introducing My Shamba Digital – Kenya’s Online Conveyancing Portal

We sat down with Robert Muoka the CEO and founder behind My Shamba Digital to discuss his company’s successes, challenges, and what might come next in the legal tech market.

Tell us a little bit about your company and why you set it up – what was the problem you were trying to solve?

My Shamba Digital is an online platform that assists land proprietors, citizens, and other stakeholders to interact, with the help of qualified and licensed professionals, with the Ardhisasa online platform. Ardhisasa is a new online national land information management system platform that allows citizens, other stakeholders, and interested parties to interact with land registration information held and processes undertaken by the government. Applications are handled through the platform and responses are presented through it.

I set up My Shamba Digital in the early quarter of 2021 in collaboration with my pupil master, Mr. James Kipkemei. Initially, it was developed to help assist our clients to register with the Ardhisasa platform, but we then decided to extend the service beyond our client base to provide a one-stop shop for conveyancing services for both buyers and sellers.

Why did you create it – to fill a particular gap in the market or as an extension of your legal services offer?

What I am most proud of are the long-lasting partnerships that I have been able to forge in the journey to realise the dream that is My Shamba Digital. It would be a shame if I did not name them, they are as follows –

  • Smartifydtech is a web development service provider that designs, constructs, supports, and evolves various sorts of web-based services and web development solutions. These services span from brand research to conception, constructing UX/UI design, and a marketing plan.
  • Proper bookings, one of the leading online booking travel companies in East Africa.
  • Sheria Online, an online legal consultancy and research company that provides legal solutions.
  • Build Soko an online construction marketplace for building products and finishes across Kenya with over 5,000 materials with new ones listed on a daily basis.
  • Design Fourteen Company Limited is an interior design, construction, and real estate company.
  • East Africa HiiL Innovation Hub is a non-profit organization dedicated to finding and supporting the world’s best justice entrepreneurs in East Africa in collaboration with the Hague Institute for Innovation (HiiL). They endeavor to bridge the justice gap and provide justice that is affordable, fast, accessible, and easy to understand delivering fair outcomes.
  • Last but not least, the African Law & Tech Network, an online community and hub for collaboration, creativity, information, and opportunities for African legal services providers, tech entrepreneurs, regulators, policymakers, and investors.

I also look forward to forging more partnerships with the various stakeholders involved in the conveyancing sector.

What is the greatest challenge you have faced?

I have faced many challenges in the journey to fully operationalize MyShamba Digital, the greatest challenge however is the lack of adequate finances. Lack of funding is a challenge that most young lawyers face which older lawyers of the earlier generations never had to face; a fact asserted by my law school lecturer Dr. Kariuki Muigua in his treatise Legal Practice and New Frontiers: Embracing Technology for Enhanced Efficiency and Access to Justice.

What are the top challenges facing African lawyers and businesses today, in terms of data and technology and how can they be addressed?

The documented challenges facing African lawyers and businesses in relation to data and technology are complying with the privacy laws at the national and international levels, such as the storage of Personally Identifiable Information (PII) and Personal Health Information (PHI) and wrap tight controls around the processing, use, and transfer of such PII and PHI.51

These challenges can be addressed by both businesses and lawyers through investing in data protection infrastructure which enables efficient work-flow and protects client data regardless of the status of the local data protection laws. Furthermore, they should seek paralegals and legal assistants with expertise in technology-driven systems to help their firms operate more efficiently in order to facilitate efficiency and guarantee data privacy.

What legal tech innovation do you think will be most widely adopted in Africa in the next decade? And why?

The legal tech innovations that I firmly believe will be adopted widely across Africa in the next decade are My Shamba Digital and Sheria Online.

My Shamba Digital will be adopted because it is Africa’s first digital vertically integrated platform for land and property transactions where users can access a team of licensed professionals with vast experiences in their respective fields, a resource centre with all the laws and regulations that govern land transactions, a frequently asked questions section, an e-bookshop, a blog page (MyShamba Digital Blog),  a property listings section that encapsulates a staycation (MyShamba Property Listings) and a land selling platform (MyShamba Soko).

Sheria Online on the other hand will be adopted across Africa as it enables its users to access legal research, representation and consultancy services as well as access to legal information in their flagship e-bookshop and blog page.

What regulatory and legislative environment is required to facilitate greater use of technology in the African legal sector?

The Kenyan approach by policymakers to enact amendments that enhance the application of technology in the legal sector is a regulatory and legislative approach that other African countries should emulate to facilitate greater use of technology in the African legal sector.

These amendments include the use of technology in judicial proceedings in the Kenyan courts by virtue of the Civil Procedure (Amendment) Rules, 2020; the Electronic Case Management Practice Directions, 2020 and the Business Laws (Amendment) Act, No. 1 of 2020, that recognizes the use of advanced electronic signatures amending the Law of Contract Act, Cap 23 of the Laws of Kenya.

How best can lawyers influence and shape the legislative and policy environment to enable the growth of the African technology sector?

Lawyers can best influence and shape the legislative and policy environment to enable the growth of the African tech space by participating in forums that seek to achieve this goal, offering legal services to start-ups and stakeholders in the African tech space, and founding start-ups that provide digital legal solutions.

Do you see an opportunity to scale your business outside of your home jurisdiction – and if so, where next?

I definitely see an opportunity to scale up the operations of My Shamba Digital across the Kenyan borders. The first step is partnering with professionals based in the wider East African region. These professionals will be advocates, surveyors, physical planners, architects and land valuers in the wider East African region as we seek to streamline conveyancing related transactions. I also look forward to listing properties across Africa in My Shamba Property Listings page as well as all books published by professionals in the conveyancing sector in the e-bookshop.

Who or what is your greatest inspiration?

My greatest inspiration is my mother who is my hero, mentor and role model. In the words of Washington Irvin,

“A mother is the truest friend we have, when trials heavy and sudden fall upon us; when adversity takes the place of prosperity; when friends desert us; when trouble thickens around us, still will she cling to us, and endeavor by her kind precepts and counsels to dissipate the clouds of darkness, and cause peace to return to our hearts.”
